Terms of Service

These Terms of Service govern your use of PixDeel and the storefronts operated on it. By using PixDeel or buying media through it, you agree to these terms. If you do not agree, please do not use the service.

1. The service

PixDeel is a platform where photographers publish event galleries and buyers purchase photos and videos. PixDeel provides the technology and payment handling; each photographer is responsible for their own content and storefront.

2. Eligibility

You must be at least 18 years old, or the age of majority where you live, to buy media or open a photographer account. By using PixDeel you confirm that you meet this requirement.

3. Buyers and photographers

Buyers do not need an account to purchase. Access to your purchases is granted by verifying your email, with an optional "remember me" credential described in the Privacy Policy.

Photographers register an account, agree to the applicable photographer and payout terms, and are solely responsible for the lawfulness of the media they upload and sell, including any required consent of the people depicted.

4. Purchases and payments

Prices are shown before checkout and charged through our payment processor. Because digital media is delivered immediately, purchases are generally final. If a file is defective or you were charged in error, contact the photographer or us and we will work to make it right.

Purchases are transactions between you and the photographer. PixDeel is not required to intervene in a dispute between you and a photographer, but it may do so at its discretion, including by removing content or issuing a refund through the payment processor, and the remedy PixDeel applies is the platform's final decision on the matter. This does not limit any right you have under card-network chargeback rules, or any consumer right that cannot be limited or waived by contract.

5. Content and your license

Photographers retain ownership of their media. When you buy an item, the photographer grants you a personal, non-exclusive license to use it for personal, non-commercial purposes, unless the storefront states otherwise. You may not resell, redistribute, or use purchased media commercially without permission.

The content standards of the platform apply to everyone. The following are prohibited on PixDeel, in media offered for sale and in anything else submitted to the service (including selfies used for face search and reports sent to us): child sexual abuse material and any sexualization of minors; pornography, sexually explicit content, and nudity; non-consensual intimate imagery; gratuitous graphic violence or gore; hate content and hate symbols; harassment, bullying, or doxxing; promotion of illegal activity; content that infringes third-party rights, including intellectual property, publicity, and privacy rights; and fraud, misrepresentation, or fake profiles.

7. Intellectual property

The PixDeel name, brand, and platform are owned by PixDeel. Photographer media belongs to the photographers. Nothing in these terms transfers ownership beyond the limited license granted on purchase.

8. Disclaimers

The service is provided "as is" and "as available" without warranties of any kind to the fullest extent permitted by law. PixDeel does not warrant that the service will be uninterrupted or error free.

9. Limitation of liability

To the fullest extent permitted by law, PixDeel is not liable for indirect, incidental, or consequential damages. Our total liability for any claim relating to the service is limited to the amount you paid through PixDeel in the 12 months before the claim.

10. Indemnification

You agree to indemnify PixDeel against claims arising from your misuse of the service or your violation of these terms or applicable law. Photographers additionally indemnify PixDeel against claims arising from the media they upload and sell, including claims under privacy, publicity, and biometric privacy laws relating to the people depicted.

11. Enforcement and termination

PixDeel may remove content, restrict features, or suspend or terminate access, at its discretion, for violations of these terms, to protect the platform or its users, or where the law requires it, with notice where practicable. We do not commit to response times and do not operate a formal appeal process. When we remove content or restrict access, we give the affected person the reason, unless the matter involves child safety or we are legally restricted from doing so, in which case no notice is given. Removal for legal or safety reasons can include media that has already been purchased. Accounts of repeat infringers, including repeat copyright infringers, will be terminated in appropriate circumstances. You may stop using the service at any time and exercise your privacy choices as described in the Privacy Policy.

12. Governing law

These terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws rules, and disputes will be brought in the state or federal courts located in Wyoming. If a mandatory consumer-protection law of the place where you live gives you rights, or a different forum, that cannot be limited or waived by contract, nothing in these terms takes those rights away.

13. Changes to these terms

We may update these terms. Material changes take effect when posted with an updated date. Continued use after that means you accept the updated terms.
